Stile italiano
Si, sono stato convocato come testimone ad oltre 200 km di distanza per un sopralluogo effettuato 5 anni fa. Questo comporta la perdita di una giornata di lavoro, spese per lo spostamento..... Diligentemente ho firmato che ho ricevuto la convocazione ma solo in seguito ho potuto constatare che qualora non mi presentassi potrei incorrere in un'ammenda che va da un minimo di 100,00 ad un massimo di 1.000,00 euro!
Con cortesia ho chiesto a chi "aveva interesse" che fossi presente come teste, oltre al difensore che ha fatto in modo che fossi convocato, un riconoscimento alle spese a cui andavo incontro.... Il silenzio è d'oro, visto che non ho ricevuto alcuna risposta.
Ho deciso di prenotare il treno... e, che bello, le ferrovie dello stato mi informano che ho aiutato il pianeta: con la mia scelta ho prodotto ben il 92% di anidride carbonica in meno di quella prodotta dall'auto. Bravo.
Partenza in orario da Peschiera del Garda; tappa a Milano e senza dover cambiare treno è previsto l'arrivo a Pavia.
Accidenti, prima di arrivare a Lambrate il controllore informa che per uno sciopero regionale di alcune categorie, il treno non proseguirà oltre Milano. Altri dettagli non sono in grado di comunicarcelo. Come arriverò a Pavia per la mia bella testimonianza?
Ho difficoltà a comprendere il motivo per cui una società Statale (Trenitalia) ha all'interno servizi che decidono a livello regionale...
A Milano chi è ai binari non sa nulla dello sciopero....poi arrivano i macchinisti e, sia lodato il cielo, il treno se pur con 15 minuti di ritardo, riparte con la sorpresa generale di chi ormai aveva perso le speranze.
Giungo felice e in perfetto orario per la mia testimonianza. In realtà hanno voluto fare una sorpresa alla controparte (d'altra parte siamo sotto Pasqua): non erano stati informati della mia presenza. Poco male. Entro orgoglioso del mio apporto per la giustizia e l'avvocato (signora) mi fa leggere la frase di prassi dove dirò la verità (quando mai ho mentito?).
Più volte sono pronto per estrarre il documento d'identità....ma nessuna delle persone presenti me li chiede (fra l'altro non conosco nessuno); forse sono a conoscenza del mio sito internet o forse mi hanno visto recitare, o forse avrei potuto mandare un sostituto e non perdere la giornata lavorativa.
Signori esperti, è normale non accertarsi dell'identità degli interrogati?
Alla prima domanda sono colto da terrore. Mi chiedono se nel mese di giugno (o luglio?) 2003 avevo eseguito un sopralluogo.... Estraggo rapidamente il report che avevo stilato in quell'occasione e contesto la data: il mio intervento risaliva al 20 novembre 2002, almeno 7 o 8 mesi prima! Lo attestano le note spese di allora!
Dalle successive domande comprendo che molto probabilmente chi mi ha convocato l'ha fatto pensando che fossi stato presente durante un sopralluogo avvenuto in data successiva alla mia.
Come potevo rispondere a fatti che non avevo rilevato?
Mi licenziano e così visito Pavia, il Ticino, la chiesa di San Francesco... e riprendo il treno per il ritorno.
Peccato, il ritardo di 15 minuti mi fa perdere la coincidenza del treno successivo....quello di Milano direzione Venezia.
"Caro signore, se il treno ha meno di 30 minuti di ritardo non può chiedere alcun risarcimento" mi informa cortesemente il controllore (questa volta del Veneto pertanto la tratta non è di sua competenza).
Sunto: mi sono rubato una giornata di ferie, ho reso una testimonianza incompleta, ho perso il treno giusto, ho conosciuto un'appassionata apprendista avvocato, ho visto Pavia, ma ho un grosso nodo alla gola per come la mia presenza come teste sia stata pressapochista. Certo che se anche i processi importanti si svolgono nello stesso modo...è proprio lo stile italiano.

Italian style
I've been summoned as a witness at more than 200 kms of distance for an effected fact that happened 5 years ago. This involves the loss of a work day, the cost for the journey..... Industriously I signed for the convocation that I have received but only subsequently I could ascertain that if I will not go I could incur in a fine that could be from a minimum of 100,00 to a maximum of 1.000,00 euros!
I asked to whom "it had interest" that as witness I will be present, and at the defender that decided to summon me, a recognition to the expenses to which I'll had.... The silence is gold, considering that I have not received any answer.
So I book a train... and, marvelous, the railroads society informed that I have helped the planet: with my choice I have produced well 92% of carbonic anhydride less than the one produced by the cars. Bravo.
Departure on time from Peschiera del Garda; I'll arrive in Milan and I do not have to change train to Pavia.
My goodness, before reaching Lambrate the inspector informed that for a regional strike of some categories, the train won't continue over Milan. They couldn't tell other details to us. How can arrive in Pavia for my precious presence.
I'm not able to understand the motive for why a National society (Trenitalia) has inside services that decide at regional level...
In Milan the person in service doesn't know anything about the strike.... then the drivers arrive and, the sky is praised, the train with only 15 minutes of delay, leaves the station with the general surprise of whom had lost the hopes.
I arrive happy and in perfect schedule for my testimony. Probably someone thought to make a nice surprise to the counterpart (we are close to Easter time): they had not been informed of my presence. This is not a problem. With proud I bring my testimony for the justice and the lawyer (a lady) asked me read the sentence where I'll say the truth (did I ever lied?).
I was ready to extract my document of identity two o three time.... but none of the present people asked me to do this (among the other I didn't know anybody present ati the meeting) ; perhaps they know me for my internet site or probably they have seen me recite... I could have been able to send a substitute and not losing the working day and no one would notice who could be there for me.
Is it normal not verify the identity of the witness
At the first question I was terrorize. They asked me if in the month of June (or July?) 2003 I had performed a visit in one swimmingpool.... I quickly Extract the report that I wrote in that occasion and context the date: my intervention went up the November 20 th 2002 (the previously year)! My notes for the expenses attested this!
After the next questions I understand that very probably the person that summoned me has done this mistake thinking that I was present during a different time, the next year.
How could I'll be able to answer the facts thah I haven't never seen?
They dismiss me and so I visit Pavia, the Ticino river, the church of St. Francis... and I take the train for the return.
Because of the delay that was 15 minutes after the schediule, I lost the following train direction Venezia in Milan....
"Dear gentleman, if the train has less than 30 minutes of delay you cannot ask any sort of reimbursement" kindly the inspector informed me (this time was of Veneto region so not of his competenced area)
Summary: I wasted a day of my holiday, I made an incomplete testimony, I missed the correct train, I have known an impassioned future lawyer, I have seen Pavia, but I have a big knot in my throat because my presence as a witness has been inaccurate. Personaly I think that if even the important debate develops in the same way... this is really the Italian style.
